Concerning Rausch Sturm LLP, query

I’m sharing this because I had a credit card through Target, and I fell behind on payments. Now, TD Bank is suing me for the balance. According to my paperwork, they’re representing Target. I was given a phone number, and I managed to get through once to set up a payment plan. They told me they’d send a letter for me to sign and return, which would notify the court and help me avoid going to court. However, my court date is approaching, and I still haven’t received the letter. No matter how many times I call, I can’t get through to anyone. Has anyone else dealt with this company or have tips for reaching them? Thanks in advance!

If you don’t have concrete proof that the court date has been cancelled, don’t miss it. If they don’t get back to you, go see them. Perhaps they won’t, and the lawsuit will end.

That is my intended course of action. When I bring my butt there, they’ll notice that it has already been attended to. Seems like a waste of time!

Rausch Sturm is known for being disorganized and frequently loses FDCPA and FCRA lawsuits filed against them.

My advice would be to attend your court date and bring all relevant documents and call logs. Their attorney may be allowed to appear via Zoom.

You could review your credit card agreement to see if there’s an arbitration clause. If there is, you can use a website like SoloSuit to file a Motion to Compel Arbitration. If the court accepts the motion, it may delay the hearing or shift focus to the motion, which could force R. Sturm to communicate with you again.

You might also consider filing a complaint with the CFPB, stating that R. Sturm isn’t cooperating and hasn’t sent the required documents. While you can’t use the complaint itself as evidence, their response, which could take 14-60 business days, might prompt them to re-engage and send the necessary paperwork.

They haven’t been answering their phones for over a week.

I’m trying to pay my debt, but the online portal says, “Due to a pending payment, we are unable to process a payment on your account through our web portal at this time. Please contact an account representative to discuss your account.”

I’ve emailed them, called multiple times a day, and left a voicemail. Still no response.

What am I supposed to do? I don’t want them to take me to court again!

Alright, let me start by assuming that you live in the US. Please disregard everything I’ve written if you’re not.

Why is your court date today? Did you ask for one and reply to the court? There should only be a deadline for requesting summary judgement if you failed to request a court date.
By whom are you being sued? It’s Rausch Sturm or TD Bank? In any case, give them a call and find out why the mail wasn’t delivered to you. Were they sending you a stipulated judgement letter?

I’m in the US and didn’t know anything had been filed against me until I got a letter from an attorney saying a lawsuit had been filed in my county.

TD Bank is suing me.

From what I understand, the summons is for a pre-trial conference.

Rausch Sturm represents TD Bank, and they were the ones I was told to contact to resolve the matter and set up a payment plan.

They were supposed to send me a form confirming it had been resolved, but I can’t reach them to find out what’s happening.

I don’t have any experience with the court system or how this works. My current plan is to show up and demonstrate that I’ve made an effort to resolve the issue. :face_with_spiral_eyes:
