Midland Credit Management filed debt collection lawsuit in the wrong county… will they refile?

Midland Credit Management is suing me for a debt, but they filed the case in the wrong county. They even tried to serve me at my parents’ house, but I don’t live there anymore. I now live in a different county. Do you think they’ll refile the case in the right county, or is it too much trouble for them to bother?

Did your parents refuse to accept the service? I wouldn’t just assume it’ll be thrown out. Keep an eye on it.

I used my parents’ address because I was staying with them between moves. This was back in February, but I moved in April.

Who was the original creditor and how much was the debt? You could try asking for arbitration, which could cost MCM at least $2,000. That might make them back off.

I used to work as a debt collector. You should call them and try to work out a settlement or payment plan. If they refile, there will be court costs, service fees, legal fees, and interest, which could push the total over $2k.

You could wait to be sued again or contact MCM, tell them they filed in the wrong county, and demand arbitration based on Synchrony’s terms.

They’ll refile about 98% of the time.

Contact the court. There should be a number on the paperwork. Let them know they served it in the wrong area. Just don’t give Midland your address. This will give you some time if you don’t have the money to pay them yet.
