Salary Disbursed by Resurgence Law Group

I’m new to Reddit and really need some financial advice.

My mom, the hardest working person I know, is going through the toughest time of her life. She’s been struggling with money for years, and things got even worse when my dad, her husband, left us to deal with rent, unpaid bills, and everyday necessities on our own. We’re barely scraping by, often not having enough for food, and even though she’s $30k in debt, my mom still somehow manages to prioritize me and my sister.

But now things have taken a turn for the worse. Over the past year, my mom received three letters from a company called ‘Resurgence Legal Group,’ claiming she owes money for a “fee” from 12 years ago. The letters didn’t explain how to pay it, and when we tried contacting them by email and phone, they never responded. We thought it might be a scam, so we didn’t take it too seriously—until today.

This morning, my mom came to me in tears. A sheriff had shown up at her job to notify Payroll that her wages would be garnished, and now $400 will be taken from each paycheck until a $7,000 debt, supposedly owed to Resurgence Legal Group, is paid off. We had no idea this was happening. We weren’t informed of any court order, and if we had known, we would’ve tried to work something out or request an exemption.

Now, my mom is thinking about filing for bankruptcy because we really can’t afford this, and we don’t know what else to do. Is filing for bankruptcy the right move? What are the risks? Has anyone else dealt with these debt collectors before?

Sorry if this comes across as more of a vent I’m just heartbroken. Seeing how much this financial stress is hurting my mom is unbearable. When she told me today that she doesn’t know if life is worth living anymore, it shattered me. I’m panicking and don’t know where to turn.

Before this occurred, your mother received numerous notices. At least one of them mentioned that she had been sued. She disregarded them.

I’m not sure why people don’t contest any letter claiming they owe money to a creditor right away. Don’t talk to anyone, don’t call. File a complaint. I apologise that it’s too late for you, but I would speak with a lawyer because there’s a possibility that the statute of limitations on a debt from 2012 has already passed.

Since nobody else in my family knew the seriousness or legitimacy of this, it’s possible that she was unaware of it as well. In all honesty, we’re just really naive in circumstances like this. I appreciate your advice.

Right now, you could place a wager on that. She disregarded the warnings, which is not something you should do. Never. If you suspect a scam, always request verification of the debt via confirmed mail, and you can proceed from there. Which state do you belong to?

That doesn’t make sense because years is older than the SOLs for all states.

Since the majority of states only allow six years, this sounds fishy unless she made payments or utilised the card/account during the six years before the case.

They went to court, obtained a signed court order, and obtained legal means to collect, but she disregarded all of the notices and letters. She is powerless to stop it. Seven thousand is not a lot. Her troubles are of no consequence to the law. Her best option is to request a payment plan from the individual executing the garnishment in order to settle the debt.
